ANNEX 1: SUPPLEMENTAL LICENSE AND PRIVACY TERMS PERTAINING TO MINDSPARK BROWSER

(THE “BROWSER SUPPLEMENTAL TERMS”)

Without limiting any of the restrictions, limitations, or rights set forth in the End User License Agreement and Privacy Policy (the “Standard Terms”), all of which Mindspark reserves, the following end user license and privacy terms (the “Browser Supplemental Terms”) also apply in connection with your download, installation and/or use of a Mindspark chromium based web browser (the “Browser”). In the event of a conflict between these Browser Supplemental Terms and the Standard Terms, the Browser Supplemental Terms will govern.
If you fail to comply with the terms of these Browser Supplemental Terms at any time, we reserve the right to terminate your access to the Browser. We may discontinue or alter any aspect of the Browser, at our sole discretion and without prior notice or liability. You are responsible for obtaining or providing all access lines, including DSL, cable, or other network services or devices necessary to access the Browser.
The Browser incorporates certain open-source software, which is subject to the license provisions dictated by the publishers of such software. Information regarding such open-source software is contained in the Browser’s “about” listing. Specifically, the Browser is made possible by the Chromium open source project https://www.chromium.org/. The provisions of these Browser Supplemental Terms do not limit the applicable open-source license grants, however, such open-source license grants do not limit or modify any of the limitations of liability, disclaimers, indemnities, remedy limitation provisions and other applicable restrictions set forth in the Standard Terms or these Browser Supplemental Terms.
As the Browser processes are largely automatic, we do not screen the third-party websites included or linked to or from the Browser, and these third-party websites are operated by persons over whom we exercise no control. As a result, we assume no responsibility for the content of any third-party website or URL to which a Browser links or refers and we are not responsible for errors or omissions or for offensive or objectionable content contained on a website or URL to which a Browser links or refers. We are not responsible for the security and privacy choices you make with respect to the Browser or risks of encountering malware, computer viruses, and illegal behavior of others when interacting with third party websites and content. You understand that by using the Browser you may be exposed to content that you may find offensive, indecent or objectionable and that, in this respect, you use the Browser at your own risk. You agree that you are solely responsible for (and that we have no responsibility to you or to any third party for) any content that you create, transmit or display while using the Browser and for the consequences of your actions (including any loss or damage which we may suffer) by doing so.
The Browser collects certain data about the device onto which you have installed the Browser (including your hardware profiles, cookie text files, browser extensions, device IDs and IP addresses) and your interaction with the Browser, including, without limitation, the browser searches conducted and search results displayed, websites and web pages you visit and the content provided there through and your clicks and interactions with such websites and web pages. Details about our data collection and use practices are set forth below in these Browser Supplemental Terms and the Mindspark privacy policy included in the Standard Terms. A) MS Personal Information. We reserve the right to use and share your personal information to diagnose Browser errors and malfunctions, to investigate and report instances of prohibited user behavior and to respond to legal processes.
B) Usage Reporting. The Browser automatically transmits information to us regarding your interaction with the Browser. We use this information in aggregate form to improve our internal operations and software.
C) History & Bookmarks. The Browser may maintain a history of your recent search activity to improve your browsing experience and may allow you to bookmark web pages for quick reference and access. You may delete this locally-stored information at any time through the user controls contained within the Browser.
D) Geolocation Data. The Browser allows you to share your geolocation information with third-party websites and services. Use of your geolocation information will be governed by the applicable terms of service and privacy policies of the third party websites and services with whom you choose to share this information. We encourage you to review such terms and polices before sharing your geolocation information.
E) Third Party Sign On. The Browser may provide the option for you to sign onto one or more third party services (such as Facebook or Twitter). To use this feature, you will need to provide personal information, such as you user name and password, in order to link and sign onto the third-party service. This information is not transmitted to us and your use of this feature is at your option.
F) Do Not Track Policy. The Browser is configured to respond to browser-generated do not track signals. We make no representations regarding the do not track policies of the websites or services included with or accessible through the Browser and you are directed to the privacy policies of each such respective service or website for information about their policies.
G) Processing of Personal Information. YOUR PERSONAL INFORMATION MAY BE PROCESSED BY US IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS OTHER COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY. BY USING THE BROWSER AND PROVIDING ANY PERSONAL INFORMATION, YOU ARE CONSENTING TO THE TRANSFER OF DATA FROM YOUR COUNTRY TO A COUNTRY THAT MAY HAVE LESS STRINGENT LAWS, AND THE PROCESSING OF YOUR PERSONAL INFORMATION IN CONFORMANCE WITH THIS POLICY.
